Benefits of an Estate Planning Lawyer

Power of Attorney Specific:

There is a power of attorney which is called a general durable power of attorney. That means that that is in place and can be used regardless of whether or not the person is ill or not and can consent or not.

There is something else that is called a specific power of attorney. A specific power of attorney means that you give a certain power to someone else to do some specific task for you, nothing more, nothing less, in order to be able to do something for you where you can’t be there. A good example of that is sending someone to a real estate closing with the specific power to sign one document on your behalf and collect your check and bring it back to you. Okay? That’s the difference between a specific power of attorney and a durable power of attorney.

I should add one other thing. Powers of attorney can be rescinded in a very simple way. If you decide you don’t want that power of attorney, you simply tear it up and throw it away.
