No Will and Minors:

The question is if -- if one or both parents pass away and there are minor children, there is a real difficulty. If one parent is still alive, obviously then the children stay with that surviving parent. If both parents are gone, then someone will have to qualify to take those children in. This involves the court. Because you just can’t just take children and live with you. There has to be a formal proceeding, and it can get complicated. But the long and short of it is is that the court wants to do what’s right for these children, and that’s the kind of ruling that I’m sure that you and I would both want to see.
