Destroying a Will:

When you write a will that document is supposed to speak at the time of your death. And by speak I mean it then has meaning and substance at that point. Before that time you can change that will any way you want, and that’s called revoking a will. The way you revoke a will essentially is to either tear it up or destroy it. You have to do something affirmative in order to be able to cancel out that will and put a new one in place. And what I don’t recommend is that you do that before having a new will put in place. Because between the time you revoke that will and put a new will in place you’re going to be without a will. You’re going to die intestate if that instant in time you don’t have a will. But the way in which you revoke a will though is to destroy it and dispose of it, and then there is no will.
